If I am a man, I have no children, but I have other close relatives, who will inherit my properties after me and what will be their shares? I discuss different situations below.
A. Wife, mother, father, brother and sister
If I am a Hindu, wife – 1/2, mother 1/2.
If I am a Christian, wife – 1/2, father – 1/2
If I am a Parsi : wife – 1/2, mother 1/4, father – 1/4.
If I am Muslim : wife – 1/4, mother – 1/6, father 7/12.
Their shares will be as follows:
B. Mother, father, two brothers and a sister.
If I am a Hindu, my mother will inherit the whole property.
If I am Christian, my father will inherit the whole property.
If I am a Parsi, my father and mother will take half share each.
If I am a Sunni Hanafi Muslim, their shares will be: mother – 1/6, father – 5/6.
Their shares will be as follows:
C. Father, brother, two sisters
Whatever my religious faith, my father will inherit the entire property.
Their shares will be as follows:
D. Mother, two brothers, sister
If I am a Hindu or Parsi, my mother will inherit the whole property.
If I am a Christian, mother – 1/4, each brother 1/4, sister 1/4.
If I am Muslim : mother 1/6, each brother 1/3, sister 1/6.
Their shares will be as follows:
E. Brother and sister, predeceased brother’s wife and son, predeceased sister’s husband and two daughters.
If I am a Hindu : surviving brother – 1/2, surviving sister – 1/2
If I am a Christian of Parsi: surviving brother – 1/4, surviving sister – 1/4, son of predeceased brother – 1/4, each daughter of predeceased sister – 1/8.
If I am a Muslim: surviving brother – 2/3, surviving sister – 1/3
Their shares will be as follows:
No close relatives
If I do not have any of the relatives mentioned above, my other farther relatives will inherit my propertiesWho will inherit and how much again depends on my religious faith. Often, relationships are counted in how close or far they are from me in degrees.
No relatives
If I have no relatives at all, the property goes to the Government.
Nature of relationship
Generally, these relatives must be connected with me by blood, valid adoption or valid marriage.
